Copying levies exempt schools, companies and private individuals from having to obtain permission from the individual rights holders before using texts and images. The statutory license prescribes, as compensation for the authors and publishing houses, a royalty to the collecting societies. This system is referred to as mandatory collective management. It simplifies licensing for users and ensures that authors and other rights holders receive a royalty.
Copying levies concern uses that the Copyright Act allows within the scope of private use and at the same time makes subject to a royalty. These include, for example, photocopying, scanning or digital storage of protected works in companies, schools, public administrations and other organizations.
The use is permitted by law. Instead of an individual consent by the rights holders, a statutory royalty is paid.
Mandatory collective management is regulated in the Copyright Act (CopA). For private uses, Articles 19 and 20 CopA are decisive. Here the law obliges the authorized collecting societies to define tariffs and to claim royalties.
The collecting societies work together for this task, with common tariffs («CT»).
The tariffs are negotiated with business associations and other representatives of the users and approved by the Federal Arbitration Commission for the Management of Copyrights and Related Rights (ESchK).
This results in transparent, appropriate and uniform conditions throughout Switzerland.
The system reduces the administrative burden of rights and uses:
This means that users do not have to obtain rights separately for each individual work. At the same time, the rights holders receive a royalty for uses that can hardly be licensed individually.
ProLitteris manages copying levies for literary and visual works. These include in particular royalties for photocopying, scanning and digital storage of protected content within the scope of statutory private use. Which license or which tariff applies depends on the respective use.
